The new minimum wage of €1,221 raises the income threshold to €915.75 gross per month. Those who exceed it may lose their aid, but there are options to maintain it.

The State Public Employment Service (SEPE) has updated the income limit for accessing and maintaining unemployment subsidies. Following the publication of the new Minimum Interprofessional Wage (SMI) in the BOE on 19 February 2026, the threshold is set at €915.75 gross per month, compared to €888 in 2025.

This requirement, known as income threshold, is key to receiving any assistance subsidy. Those who exceed this amount on a monthly basis will lose their right to the benefit, unless they opt for one of the avenues permitted by the regulations.

What incomes does SEPE consider?

SEPE does not only look at salary. It also includes pensions, rents, financial returns, and capital gains, always in gross terms and excluding the proportional part of extraordinary payments.

In subsidies such as for those over 52 years old, only the applicant's own income is assessed, excluding that of the spouse or children. In other cases, neither individual incomes nor the average of the family unit can exceed 75% of the SMI.

Options if you exceed the limit

If your income exceeds €915.75, SEPE may suspend or terminate the subsidy. Deliberate concealment of income carries financial penalties and the loss of future aid.

There are several legal avenues to avoid losing protection. One is to request temporary suspension if the income increase is temporary; once back below the limit, resumption can be requested.

Another option is to combine the subsidy with employment through the Employment Support Complement (CAE). For this, the salary must not exceed 225% of the IPREM, which is €1,350 per month (IPREM 2026: €600). The complement is paid for a maximum of 180 days.

Finally, it is mandatory to inform SEPE of any income changes within the established deadlines to avoid penalties.

What to do if in doubt

In the event of any change in your finances, inform SEPE as soon as possible. The regulations vary according to the type of subsidy and family responsibilities, so it is advisable to consult a professional or visit a SEPE office for a personalised calculation.

Remember that the limit of €915.75 is monthly and in gross terms. Keeping track of your income will help you avoid unpleasant surprises and maintain aid if you meet the requirements.
